In September of this year, Wang, a 62 years old man from Hancheng City, Shaanxi Province, wanted to clear doubts that he's had for many years. He took blood samples of himself and his 37 years old son and sent them for paternity test. When the result came back, it showed that the two were not biologically related, so Wang decided to file for divorce from his wife. On December 12, Hancheng City People's court rejected his request and declined to issue a divorce. But things were not that easy, let's see what happened.
Not biological father
Wang and his wife Niu are both from Hancheng City. According to the judgment, they were introduced to each other in 1981 and married in 1982. After marriage, they had a son and a daughter. Son is 37 years old and the daughter is 36 years old. Wang said his daughter is currently married, but his son suffers from mental illness which started when he was around 16 or 17 years old and has no ability to work at present.
Wang said that he had always had doubts about whether the son was truly his or not, but he did not do anything, he chose to raise the child anyway. But this year situation got worse and wife-husband relationship got bad so he decided to do the paternity test.
At the beginning of their marriage, their relationship was OK, according to Wang. But in 1996, his wife ran away from their home and for nearly three years, he was raising his children and searching for his wife at the same time. At the end of 1998, he found his wife and took her home. But soon after that, their son developed mental illness.
In the past two years, the relationship between the wife and husband deteriorated again. due to this, from October last year, Mr. Wang has lived in his daughter's house for a period of about half a year. This year, the couple have often fought and sometimes even police were called to resolve their conflict. In September this year, Wang decided to take the paternity test.
Wang told the court that after founding that his son is not his biological son , he suffered a serious mental attack. He believed that the defendant had destroyed the loyalty and trust between the husband and wife, and the relationship between them was completely broken. Therefore, he filed for divorce and requested the defendant to pay him 86,400 yuan for raising 'their son' and 100,000 yuan for his spiritual/mental loss.
His wife on the other hand, said that she had been married to the plaintiff for 38 years, and the relationship between them is good. She too have contributed a lot to the family and was already in her 60s. If she divorced now, she would not have a home to go back to, so she resolutely refused to divorce.
Along with her statement she also provided a medical record to prove that the plaintiff has domestic violence, and provided a diagnosis certificate to prove that her son had schizophrenia. Both of these were rejected by the plaintiff.
Court: No Divorce
On December 12, the people's Court of Hancheng held that the plaintiff and the defendant had been married for 38 years and had established a stable relationship between husband and wife. Both parties should cherish it more. After marriage, both parties had made hard efforts for family life and devoted their common efforts to the growth of their children. The plaintiff is now suing for divorce on the ground that his son, who is 37 years old, is not his biological son. For a 62 year old man, this kind of life change does cause serious psychological harm.
However, the judge said if both can re-examine their problems, face them together and make rational choices, there is a possibility of reconciliation. Furthemore, the judge thinks that their relationship has not been completely broken.
Judgment: the plaintiff Wang and the defendant Niu were not allowed to divorce.
On December 14, Wang said he would appeal for a divorce.
